If November 1973 is considered one of the best months in Grateful Dead history and 11/17/73 is widely considered one of the best shows of the month - if not the year, then Dave's Picks Volume 5 is sure to score major points as the first quarter of 2013. Dave's Picks Volume 5, or as liner note scribe Bill "Grateful Red" Walton puts it - "a three-CD package of life, love, and hope, with over three hours of glorious music, and a set and song list to dream about," is major heavyweight Dead.
A stunner of a show, the band come out blazing with phenomenal renditions of new material from the recently released Wake of the Flood, unconventional set starters and some of the finest playing of the year. The first set features one of the hottest, most inspired versions of "Here Comes Sunshine" ever - widely regarded as one of the Top 3 versions of this song ever, and a "China>Rider" that's up there with the best of 1973-1974, and that's saying something. The second set shines the spotlight on the best of the three "Playing>UJB>Dew>UJB>Playing" musical palindromes (the 2nd of 3 times they did this sequence), with every second of it exciting and interesting. And they top that off with a late-show "Eyes Of The World" that is remarkably hot and energetic. To the ears of many, this is a top-25 Grateful Dead show of all time. I also wondered what happened to the complementary MP3 download. I never heard anything more about it after receiving the same mail that you posted. I was also not best pleased that MusicToday charged my credit card at the time of (pre)ordering rather than at or around the shipping date. I thought that sort of unscrupulous behaviour had been outlawed long ago. That the release date was then put back several times just increased my sense of outrage. Unfortunately there is little one can do when products are available from one source only. As someone living in Europe, I also come across many such monopolistic sites charging more than $20 for standard shipping of 1 CD to Europe - if you want it, you just have to pay up and try not to feel too victimised. Personally I don't think that that is an ethical way to run a business, but there is little or nothing I can do to change the situation. Sadly, greed is everywhere these days.
The "UJB" jam you hear during the transition (19 or 20 minutes in or so on the player here) is a surprisingly common progression for the band in '73-'74 period China>Riders (it bears some semblance to UJB, I guess). Check out a couple different China>Rider transitions from other '73-'74 shows. They played it at just about every show so it's very well rehearsed. Here's 2-24-74 to compare (it occurs just before the cut) and a couple good examples from El Paso and 12/1 Boston in the two weeks immediately following UCLA (the Boston example is pretty damn good). Of course YMMV, but methinks you are just hearing a similar series of chords...
It was a welcomed treat in my mail box yesterday. I have not finished the first disc yet but the sound is superb. I did notice an unusual transitional jam in China-Rider. Perhaps hints of Uncle John's Band, or am I imagining things?

Yeah, the Jerry site really botched the first Garcia Live release. I pre-ordered it way back on October 4th. They have postponed the release like three times since then, and, worst of all, they promised everyone a free digital download to apologize for the delay and then never delivered it. I sent an email to the site wondering where my download was, and they acted like they didn't know what I was talking about. Here is the original email:
"Dear Valued Customer,
Jerry exercised the greatest of care insuring the high fidelity in all his recording projects and we continue on in that spirit with the GarciaLive series. The deep level of care required in delivering audio to this standard will delay shipment on your Volume 1 CD set until January, 2013. To make up for the delay, we will provide a complementary MP3 download delivered via email on or before December 24th. We apologize for any inconvenience this may cause."
I like how they tried to turn Jerry's artistic attention to detail into an excuse. :-) I'm still excited to get this release, but I wish they would honor their promise to give preorderers a download.
Yes, I know that the Dave's Picks are still up (thankfully), but every one of the out of print Dick's Picks, Road Trips, and select live releases are not. That's like 60 shows compared to the 5 Dave's Picks you are referring to.
Do the people who complain about this actually check first?

didn't get my DP5 today, but i did receive my garcia live vol 1 today. the sugaree is stupendous! those 1980 jerry shows rock! maybe monday for DP5.
Got mine today and it does not disappoint! Both the boys’ playing and the sound quality are top notch. Phil is right where you want him… up front big and clean. I’ll bet even some of you Row Jimmy haters might change your tune when you hear this version. Turn it up loud until you can feel it. There are too many highlights to mention them all and I’m only up to the beginning of Uncle John’s Band and the big palindrome! I was up at Stanford at that time (was on the basketball team, played against Bill and we got our butts kicked), saw them at Maples in Feb '73 and the Nov Winterland shows and wish I had ventured down for this one. As Bill said, those were magical times and I'm happy that I was there (even though I got my butt kicked).

I got my copy of DP #5 today, and it is stellar!!!
While my copy was intact, I can certainly understand how these could get damaged in shipment. The corrugated cardboard packaging is very thin, and I was able to easily rip it in half. I really think that the packaging should be reevaluated for future DP releases.

Again, PatagonianFox, your comments reveal a complete and fundamental misunderstanding of the Grateful Dead, its culture, and now GDP. You have failed to respond to even the most basic points I addressed in my reply.
If you would like to learn more about the Grateful Dead, their musical achievements, or their relevance in history, I would refer you to any number of the excellent biographical works available on the subject today. However, I doubt that you have the ability to read any long book . . .
Listening to first disc of DaP 5 now, just lovely. I thought I would skip the China>Rider since I just heard the Listening Party, but nope, it's playing right now, can't get enough. This was one of two shows I got in my first B&P (remember those?) and it got me into trading (11/17/73 and 2/26/77 - that saint knew exactly how to hook me). The first time I heard this show (and the Swing Auditorium show) I remember thinking "I didn't know music could even SOUND like this. Thanks Dave, Norman, and crew, for this release. As someone below said, I even listened to LLR with new ears (Jerry seemed to really like playing that damn song).
Folkhippy - Just an FYI, most of the OOP discs you mentioned are now available on Spotify (for free, though that's at a lower sound quality), for example all the Dick's Picks, even things like the 2011 30 Days of the Dead. So I think that is where the OOP stuff will end up eventually.... (and no I don't work for Spotify, sorry I keep bringing it up).

Have enjoyed my Dave Pick's subscription all year. The music selection has been great as has been the packaging, essays. etc. All my discs were fine until the very last, disc three of Dave's Pick 4. It has a pretty big nick in it that makes it unplayable. Not looking to return or replace the whole thing, just disc three. Any help you can give would be great.

For those of you who haven't had the pleasure of reading or participating in a GD forum that PatagonianFox chooses to involve himself with, he brings a bad vibe, a negative attitude, and an unabashed intention of sparring with and antagonizing people to whatever discussion he gets involved with.
I don't recall if you can track someone's comments on dead.net or not, but if you can, spend five minutes and see if he has ever had an uplifting, positive impact on a discussion, or whether he lives to drag every discussion into a gutter fight. Given that most of us come here to enjoy reading and posting about music that is important to us, I humbly suggest you just ignore the person, like you would someone at a GD show trying to turn the entire audience into fans of Honey Boo Boo rather than Jerry G.
I know I have just ignored my own advice, and recognize the irony of my comment. I will not engage Mr. Fox again here, but just wanted to alert you to the path that all of his discussions go down, so that you can perhaps pretend he hasn't come here to pollute the waters, and just enjoy the rest of the nice folks here with a common love for a certain band.

some of you think the heart of the grateful dead was the fans, but let me assure you you could not be further from the truth. the heart of the grateful dead was the 5 - 7 band members who toughed it out every night. the only people who give a fuck about deadheads are other deadheads. i saw plenty of shows, i've bought a ton of grateful dead releases, and believe it or not; i've purchased some OOP GD albums on eBay. i'm a fan of the grateful dead, but some of you fanatics just make me want to puke. how desperate are you to fit in with a crowd? i'll let you in on a secret. the grateful dead were not nearly as innovative as you people want to pretend. maybe if you actually listened to another band once in a while you'd know this.
everyone here knew the score. there were a fixed number of copies, and these shows have a history of selling out. there is no reason to cry now. find the shows somewhere else.

In this day and age, it's not like the SBD that is taken down is gone forever. Many of those shows still circulate and can be easily downloaded in easy to find places. It's not exactly that they are gone forever.
That said, I do agree that after they are sold out, what is the point of removing them? It's not like a release that can be bought at any moment. If that was the case, I think it makes sense to take it down. However, with these being a limited release, I see no reason that the SBD shouldn't remain up after the item is sold out.

As I mentioned in my original post, I have bought every single live release, every Dick's Pick, every Road Trips, every Dave's Pick; I'm betting over $2,500+ spent on GD music over the past ten years. I am not asking for anything for free, I simply think that the soundboards that others have painstakingly worked to digitally transfer—sources that have been publicly available for years—should be left on the Archive when there is no alternative. I am pleased to see that all of the Dave's Picks shows are still up, but many other OOP discs, Dick's Picks, and Road Trips are not (like the Grateful Dead Movie Soundtrack, which only released snippets of the shows and then canned all of the full Archive soundboards).
If GDP/Rhino is going to run these incredible shows out of print, then why can't we at least have the old sources back? GDP/Rhino would be losing $0 on this, because they wouldn't be selling an alternative anyway. I respect intellectual property and understand why shows go off when they are officially released and kept in print, but if they are just OOP, the only one losing out on that deal is the fans.
But then again, you probably don't know what I'm talking about because you fundamentally misunderstood everything I said in my last comment, and you seem to be totally unaware of what is going on with these limited edition releases today. Which one of us is missing the point here? I sell on eBay too, but do you really think forcing fans to buy $30 sets for $150 because they are unavailable elsewhere is fair, when other sources have been freely available for years? Jerry Garcia on recordings of his live performances: "Once I'm done with it, they can have it." Patagonian, form the way you jumped to the conclusion that I was demanding a bunch of stuff for free, I'm betting there is a faded Mitt Romney poster on one of your walls. :-)
In any case, I'm not really irate as I know GDP will do all they can to remedy this in the future. They treat us Deadheads quite well and am grateful for that.

why should some get the music for free when others shell out the money to make dave's picks happen? there are more than 2000 grateful dead shows to choose from. my advice; quit bitching, and pick another show, or dare i say, listen to another band.
....and quit complaining about eBay. i sell collectable toys on eBay. i provide a service, and if you read my feedback you'd know my efforts are appreciated. nobody is forced to buy the toys i sell. sometimes i wonder why my customers wait until the toys are discontinued, when they could have just paid retail for them a few years ago, but then reality sets in, and i realize why should i care? if they're happy, and i make money its a win-win.
Are still available on archive.org for streaming purposes. I don't want to jinx a good thing, but they're all there. Hopefully this is the trend and not an exception.
As a longtime Road Trips and Dave's Picks subscriber, I have really enjoyed the remastered shows I have received. Unfortunately, someone at either Rhino or GDP has decided that it would be a good idea to produce limited numbers of these sets, allowing them to go out of print immediately after the first run sells out. In most cases, pristine quality soundboards of these shows are already available for streaming on Archive.org, but as soon as an official release comes out, that show is removed from the Archive.
Without an in-print CD to purchase, or an alternative soundboard to stream online, this music is now lost forever. How is this a good thing for the fans? It's sort of like having a full set of encyclopedias on your shelf, and, every once and awhile, the publisher comes by and tears a few of the most important pages out and then throws them in the fire.
Why, if you are only going to make LIMITED edition sets, would you take these shows down from the Archive?!?!
The guy below who says "eBay is your friend" is totally wrong. Assholes on eBay sell these DP sets for hundreds of dollars each, and most of the time they are unavailable. Try getting a Road Trips bonus disc or one of the early Dave's Picks. Get ready to shell out $70 - $150+ for a used set. Price gouging and scalping are becoming common with these releases, and GDP acts like it doesn't exist.
If you want to make money by offering subscriptions to limited edition releases, that's fine. I will pay for them. But don't deprive the rest of the community of these incredible moments in Dead history by removing them from the Archive. What about fifty years from now? How will future generations hear these shows?
GDP, you of all people should know that streaming and sharing these shows does not hurt your sales. Almost all of your releases have been in circulation for decades, but they are still selling out in a matter of days. Take the show down for a short time before it sells out, then once your warehouse is empty, put the SBD back up. Your customers will appreciate it.

DO NOT BELIEVE what customer service phone people tell you!
You should, and I am pretty sure will, be able to get the disc replaced.
Damaged discs have been replaced for limited editions in the past.
If marye is around here, I am sure she will chime in on this, but I would say:
-- Write a polite email describing the damage to the disc you got.
-- State your order number.
-- Ask for the disc to be replaced.
-- Ask for a reply.
-- Send it to both drrhino@rhino.com and deadnet@custhelp.com.
-- Follow up with another email to the same parties if they don't respond within 3 business days.
This has gotten me replacements for a bad Spring 1990 (limited) disc, and at least one other past problem.
If a disc is broken, it should be replaced... that is something that needs to be thought of prior to selling all of the discs. That is just bad business. In fact, it's pretty shady if you ask me. I have yet to have a problem, but couldn't imagine I would be very happy with a faulty product. This is something that should be addressed right away and is made right for those who have purchased a defective product.
I received a defective disc with DP 4 and was basically told the same thing. Because these are limited, there are no replacement discs. It is a risk we are taking when we purchase or subscribe...
was DaP5 really available for 2.5 months? It truly seemed more like 2.5 weeks.
I have given the GD plenty of money over the years, and I do have a copy of the p>u>md>u>p, and I do have a shtinkle of GD already, so I am not crying about it. just surprised.

After all the problems of lost shipments, broken or defective discs, and they didn’t keep a couple of hundred sets for replacements. If this is true that you can’t get damaged or lost sets replaced, I will not subscribe next year. This is just too disturbing to comprehend.
Just like 'darkstartheotherone,' below, mine arrived damaged as well...the same disc, # 2, is cracked. Customer service says it is unlikely that they can do anything about a defective disc other than a credit/refund if the release is sold-out. So it's not just you guys & gals who missed out on getting a copy who are suffering from the limited nature of these releases.
EDIT 2/4/13: The perpetually-kind marye has told us that some customer service reps are misinformed, and damaged discs should be repaired/replaced after going through the proper channels. Great news! Thanks, Mary!
This has been one of my Top 10 favorite Dead shows since the first time I heard it, however may long years ago...
This release is absolutely stunning. The Dead at their absolute best, no down moments and many peaks, and the sound is everything you've come to expect with these releases.
But you know what? The liner notes are what set this one apart. Bill Walton says it all. Worth the cost of admission, even if you already have this show in your collection, to get the thoughts of Big Red. I think he speaks for all of us...

Surprised to find this waiting at my door when I got home from work.
Going through a heavy Miles Davis phase at the moment and have been digging his bootleg series. I can't help but draw comparisons as unlikely as they might seem. Both releases deliver what they promise, a pristine recording of a live moment that neither artist intended to be "archival" releases. This is in the moment playing (on both fronts) where the musicians are truly playing as one entity.
Probably the best sound quality of the 5 Dave's Picks. Clear as a bell, like a crisp sunny day after three weeks of gray fog and rain. Warm, well-mixed so every instrument is clear. Much better, in my opinion of the Winterland 1973 set. The band plays better when they're not playing to devotees and when they played Winterland that is who they were playing to. When they've got a bit of an edge, they're a bit sharper.
LLR is not my favorite Dead song and this one catches my attention early on. I can see why Dave said this is a show he returns to often. From what I've heard so far I can see why this is one of those shows that is hard to top and I haven't even gotten to the anticipated "sandwich". Speaking of, I've listened to the Archive.org version of this show and can easily say this sounds like a completely different show just in terms of clarity of sound. Mr. Norman is to be commended as every note (Keith piano flutter fills, Jerry's guitar neck explorations and even Bob's rhythm jousts, all very present!) comes shining through.
Mexicali was alert and perky. Tennessee is slowly getting to warmed up, curious to see if the main solo delivers.
Be patient those of you who are waiting...something more memorable than any Superbowl is heading your way.

Garcia Live Volume 1 can be purchased through amazon.com for about $20.00. You won't be charged until it ships. Also, by law, if a purchase made through mail order, internet, or phone is postponed by the vendor for 30 days or more, you have the right to cancel and be refunded. Regardless of what was printed on the official Jerry Garcia site, Music Today cancelled my order without a problem. Now that I know the releases will be available from alternate sources, I won't buy from there again.
Now if my Dave's Picks will finally arrive.....
